Lipe and Kelly Win Summary Judgment Motion in Federal Court

Jeff Lipe and Ryan Kelly argued for and obtained summary judgment on behalf of a major retailer in the United States District Court for the Northern District of Illinois.  The plaintiff brought a lawsuit after she allegedly slipped and fell on an overly waxed floor.  The defendant argued that the plaintiff could not prove a dangerous condition existed at the time of her fall and that even if a dangerous condition existed, the defendant did not have actual or constructive notice of the condition.  Further, the defendant argued that the plaintiff’s claims were predicated purely on surmise, conjecture and guess and therefore, she could not prove the proximate cause of her injuries.
