Lyons and Burton Obtain Partial Summary Judgment

Jeremy Burton and Raymond Lyons argued for and obtained partial summary judgment on behalf of a plumbing product supplier in state court in Kankakee County, Illinois. In this case, the plaintiff, an insurance company in a subrogation claim, claimed that the plumbing product in their insured's home failed causing the property to flood and resulting in significant damage to the home as well as minor personal property losses.  In opposition, the defendants argued that the Economic Loss Doctrine prevents a plaintiff from claiming damages to real property when the damages arise from the home itself or a component part of the home.  The court granted summary judgment as to the plaintiff's real property claims.
