Nahrstadt Obtains Summary Judgment in Premises Liability Case

Bradley C. Nahrstadt recently obtained summary judgment on behalf of a large multi-national retailer in a case pending in the United States District Court for the Northern District of Illinois.  The plaintiff in the case alleged that she slipped and fell in the dairy and egg cooler while shopping and sustained serious injuries.  In granting the motion for summary judgment, the court found that the plaintiff had not produced any evidence that the defendant created the alleged dangerous condition or that the defendant had actual or constructive notice of the condition prior to the plaintiff’s fall.
